Chapter 17

ATF and the U.S. Attorney

What this means for Donyell

Federal agents held Brown’s gun and the bullet from Randall’s body together for 21 months, took Brown’s phones, and sat in his proffer. Their comparison, their phone download and their file have never been produced.

ATF

  • June 18, 2020: an ATF agent interviewed Brown at the Coffee County jail with the detective and told him, “if you can help us, then he goes to the district attorney and I go to the US attorney.” He offered Brown a polygraph.
  • June 23, 2020: Brown’s phones went to an ATF agent “for downloading.” No download has been produced.
  • January 12, 2021: ATF took Brown’s Smith & Wesson “and Projectile from Body.” They stayed in federal custody together until October 2022.
  • An ATF agent sat in Brown’s November 1, 2021 proffer.

U.S. Attorney, Eastern District of Tennessee

  • Prosecuted Brown in U.S. v. Brown, No. 1:21-cr-00001.
  • The federal indictment says the gun was “seized from Derik Adam Brown on May 28, 2020.” Brown’s plea papers say it was found the next day at the owner’s home.
  • An assistant U.S. attorney led the November 1, 2021 proffer.
  • The sealed supplement to Brown’s plea has not been produced.
